Most of these updates on my Google Plus site are from the week ending 6 October. After that, I was at the Masters Conference in Washington and at an event given by Symantec-Clearwell at Tower Bridge, with no time to write. I am content, in fact, to come late to my summary of these short posts – it gives s second life to subjects which would otherwise sink in the Twitter-stream.
I keep a large stock of things to write about thanks to my favourite software product, Evernote – I dip into it whenever there is a spare moment and pull out something to link to. That is fairly easy; the subsequent linking – via LinkedIn and Twitter at the time of publishing, in these updates, and (in due course) in the master list of articles on my web site, is extremely time-consuming and a major addition to my work-load. The payback comes in the form of SEO (Search Engine Optimisation) both of my own articles and of those to which I link.

Epiq Systems article: Cross-border Data Security
Peer-to-Peer, the quarterly magazine of ILTA, has published a helpful article by George Tsounis and Dan Charboneau of Epiq Systems. Cross-border trade brings cross-border data activity and that in turn generates complex difficulties, most notably between jurisdictions such as the US with demanding discovery regimes and those like the EU with tight restrictions on the use of personal data.
The article considers these implications (it has, for example, a list of some of the main laws around the world which protect privacy) and on how to deal with them, but, as its title implies, it focuses also on the security implications which arise when data moves from place to place.

It is quite difficult to get lawyers to attend eDiscovery conferences, whether they are in-house or external lawyers. There is perhaps a sense that eDiscovery is a problem for somebody else in the firm or company and that elevated people like lawyers should not have to muddy their hands with such stuff.

The language of sales: So what? Who cares?
As you have probably gathered, I am no great enthusiast for much of the language of sales and and marketing in eDiscovery. it is, of course, easy to criticise – we have a finite vocabulary at our disposal on the subject and our target market is not renowned for its enthusiasm for anything new – and less easy to come up with better ways of expressing ourselves..
IBM’s George Parapadakis, writing in his personal capacity, identifies the chief defect of many of the messages which are sent out to the audience. His heading, So what? Who cares? – the art of being relevant invites us to look at our client-facing materials and to put ourselves in the position of the recipient. So what? Drinker Biddle forms eDiscovery subsidiary to recapture revenue from outsourcers
An article by Gina Passarella in Legal Technology News reports that Drinker Biddle & Reath has set up a subsidiary business whose sole function is providing eDiscovery management to the firm’s clients and others.
The expressed motive is provided by the high cost of external eDiscovery providers. By making a not insignificant investment in software and people, the firm aims to maximise their use across all its matters to the benefit of both itself and its clients. Many of those providers, of course, make their livings in turn by offering eDiscovery services at a cost lower than most law firms, often doing a better job as well. Drinker Biddle (who have long had a good name in eDiscovery) are, at one level at least, reacting as markets always react when new challenges appear. [More]

Washington in September 2012
The weather was dull – no good for standard tourist views, but fine for the many memorials which impressed me. These shots include the WW2 Memorial, the Lincoln Memorial, the Vietnam and Korean War Memorials, the Air & Space Museum (The Spirit of St Louis, a Hurricane and the Wright Brothers all feature), and the fine equestrian Civil War collection outside the White House.

Practical Law has published an article by Greg Wildisen, International Managing Director of Epiq Systems, which summarises the key messages from Epiq’s extremely good panel discussion in London a couple of months ago.
I wrote about that panel at length in my article Epiq Systems London judicial panel points to future of technology assisted review . The main theme which I drew from the panel was the risks faced by lawyers that others – new business models, barristers and the clients themselves – would happily take the work which solicitors were likely to lose because of their unwillingness to embrace new ways of working. Huron Legal on law firm pricing
We hear a lot about the need for law firms to consider carefully the basis on which they price the work which they do for clients. We know that the pressure is constantly to reduce fees and we hear much about alternative billing structures, many of which prove on examination to be a disguised version of the old hourly rates.
